(you didnt know we had a case going did ya?)

http://news.bbc.co.uk/2/hi/business/7450112.stm

Quote:
Dismissing the American case, US District Court Judge S James Otero said that Mr Augusto was protected by the "first sale" doctrine in copyright law.

This says that once a copyright owner gives away a copy of a CD, DVD or book, the recipient is entitled to sell it on.

The same is true of ES CPU's, namely Intel who likes to have the auctions for them pulled

Quote:
They can be recognised by markings such as "For promotional use only" or "Not for resale", visible on the record or CD artwork and sometimes on the disc label itself.

But the judge said that such labelling did not alter the legal position.

So yes, a win for ES collectors, and a strike on Intel.

Sadly, eBay does not always see it this way. I have heard of Intel using the VERO copyright thing to get engineering samples of the latest Intel cpus pulled from ebay. Of course the seller just relists them under a new name and is often not caught. I cant see Intel caring very much about ES from 1994 being sold on ebay.

I have never had a sample direct from Intel, I have always assumed the testing cpus sent to the likes of tomshardware and anandtech were sent under contract?
