Say, you bought a chip from me and it never arrived. I said I shipped it and you said you never got it. I don't not have a proof of shipment/tracking either. Will you belive me?
Of course you do not have a shared mailbox, so you would totally blame on me. But let's say the package was left at your door or your mailbox got break-in from soneone recently.
The point is that you are never sure whether the package was taken by someone or I never mailed it at all. Would you claim with Paypal? or you will just trust my words and eat the loss yourself.
Would you say it's unfair to me because your package was stolen from your front door or your mailbox got break-in? I guess not... especially if I just drop shipped it without tracking/insurace/sig. req.
I don't know about uK. But here, I ship every eBay item tracked. That's to protect myself and the buyer from the claiming situation. Because I can say I have shipped and the buyer did not buy any insurance. If I don't do that I put myself in a vulnerable position when claiming. And yes, I blame seller for not doing it (especially for high value items). No mather what the receving condition of my place. _________________ My Intel CPU Museum: http://www.mynikko.com/CPU/

Hypotheitcal mumblings aside for the minute..
FACT: you KNEW your parcel mail was available to many people in your building and you DID NOT TELL THE SELLER.
FACT: you did NOT ask or pay for insurance.
FACT: you claimed from the seller as a parcel not received knowing FULLY that it could have been stolen AFTER being deliverd to your postal box.
In my opinion you are equally liable for the missing parcel and you should have been HONEST with the seller at the time. Maybe accepting 50% of the loss.
As for knowing if the parcel was not mailed at all.. well that is the trust relationship with the seller. I know the seller here, as many others now do on this forum, and he has never let anyone down yet. Infact the way he handled your claim by trusting what you say only supports his integrity.
If I knew my mail was at risk I would have TOLD the seller to send it signed for. If there was a breakin and my mail was stolen THEN I WOULD HAVE CLAIMED ON MY HOUSEHOLD INSURANCE. NOT FROM THE SELLER.
Anyway, I dont care what you do with your parcels you send and I dont think anyone else here cares what I do with my parcels I get. Just look at the facts. |

Well. I hope you are right.
Paypal would still refund my money if the seller can't provide proof of shipment. Just like in a car accident, it does not matter who is right or wrong. People just claim whatever they can to protect themself.
Err.. actually people started to suggest me not to respoond to this thread. If you would like to continue the topic, please PM me or I will not reply on this thread. _________________ My Intel CPU Museum: http://www.mynikko.com/CPU/

I actually have to agree with JAC on this one. It probably doesn't help nikko's case with PayPal to admit partial liability in a public forum, either.

I don't know how is in USA but polish P.O. mailbox sucks - expensive, for letters and packages are different. You don't know how seller will send CPU maybe in envelope maybe in cartoon. Much time ago I bought CPU in Germany and seller sent it in paket - cartoon. It was turn back to him because I have envelope BOX. He paid second time shipping cost and third one to send again. Before I had similar accidents with polish shippments. Cheeezeee I was very nervous and stopped using this BOX. _________________ Visit ABC CPU - Virtual CPU Museum. |

I am tried of losing packages. We have two different mailboxes in our apartment. One is for letter mails which every single apartment unit has one private box for letters. For parcels, however, the whole floor shares on big box that many people have access to it. Unless it's insured or signature required, USPS will just drop the parcel into the box. That is: I can see (and take) other people's parcel and vice versa.
Before I did not have this problem because our apartment is mainly for retired people. People are all friendly and honest in our community.
Recently the university beside us bought the whole apartment area and a lot of students moved in. Not only the living quality goes down, my parcels start to disappear too. I have lost 3 important packages in recent two month (just lost one this week, damn).
I am considering renting a PO Box and use it as my primary shipping address. |
